1. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any disputes arising out of or relating to these terms, the website, or any purchase made through it shall be subject to the exclusive jurisdiction of the competent courts located in Karnataka, India, where malnad.shop is headquartered.
2. About These Terms
By accessing or using malnad.shop ("the Site"), operated by Malnad Trade Link — a proprietorship of Syed Abdul Shahid (GSTIN: 29TIPPS7817M1ZM) ("we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please discontinue use of the Site. We reserve the right to update, amend, or change these terms at any time without prior notice; continued use of the Site after changes are posted constitutes acceptance of the revised terms.
3. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. Product images, descriptions, and pricing are provided for informational purposes and are subject to change without notice. We reserve the right to refuse service, cancel orders, or restrict access at our sole discretion.
4. Intellectual Property
All content on the Site — including but not limited to the malnad.shop name, logo, product photography, descriptions, graphics, text, and site design — is the exclusive property of malnad.shop and is protected under applicable Indian and international intellectual property laws. No content may be reproduced, distributed, modified, or used commercially without our prior written consent.
5. Termination
We reserve the right, at our sole discretion, to suspend or terminate your access to the Site or any account associated with it, without prior notice, for conduct that we believe violates these Terms & Conditions, applicable law, or is otherwise harmful to malnad.shop, other users, or third parties. Upon termination, your right to use the Site ceases immediately.
6. Limitation of Liability
To the fullest extent permitted by law, malnad.shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or products purchased through it. Our total liability for any claim arising from a purchase shall not exceed the amount paid for the relevant product.
7. Refund & Cancellations Policy
Returns, Refunds & Replacements
malnad.shop accepts returns and offers replacements on eligible products that arrive damaged, defective, or materially different from what was ordered. Ceramics are handmade: variation in glaze tone, texture, crazing, weight and dimensions is characteristic of the process and is not treated as a defect. Where a return is approved, customers may choose between a replacement of the same design or a refund, subject to inspection and availability.
Policy Turnaround Time (TAT)
Customers must report transit damage, defects, or discrepancies within 48 hours of delivery, with photographs of the outer packaging and the piece. Once a return or replacement request is approved, pickup is arranged within 5–7 business days, and refunds or replacements are processed within 10–15 business days of the returned item passing quality inspection.
Mode of Refund
Approved refunds are issued to the original payment method used at checkout (bank transfer, UPI, credit/debit card, or the applicable payment gateway account). Refunds typically reflect in the customer's account within 7–10 business days after processing, depending on the bank or payment provider.
Cancellations
Orders can be cancelled free of charge within 24 hours of placement, or any time before the item has been dispatched for production/shipping, whichever is earlier. Once an order enters production or has shipped, cancellation is no longer possible and the standard Returns & Refunds process above will apply instead. Cancellation requests are accepted through email (support@malnad.shop), phone (+91 00000 00000), or the order-support section of your account, and will be confirmed in writing within 24–48 hours.
